WHAT IS A “CONFLICTS DISCLOSURE STATEMENT” AND DO I HAVE TO FILE ONE?

 

What is H.B. 914?

 

Effective January 1, 2006, Section 176.006, Local Government Code requires that persons or agents who contract or seek to contract for the sale or purchase of property, goods, or services with a local government entity shall file a completed conflict of interest questionnaire (Form CIQ) if they have a personal affiliation or business relationship that might cause a conflict of interest

 

What vendors are subject to H.B. 914?

 

§         Any person who contracts or seeks to contract for the sale or purchase of property, goods or services with a local governmental entity; and

 

§         An agent of a person who contracts or seeks to contract for the sale or purchase of property, goods or services with a local governmental entity.

 

When must a vendor file the conflict of interest questionnaire?

 

Updated forms MUST be filed no later than September 1st each year or seven business days after an event that would make a statement incomplete or inaccurate.  Failure to disclose this information is a Class C misdemeanor.

 

With whom should the form be filed?

 

The form should be filed with the Shelby County Appraisal District, 724 Shelbyville Street, Center, Texas 75935.  The form is available online at www.ethics.state.tx.us and on the appraisal district’s website at www.shelbycad.com.
